Overview

Welcome to Blooming Artificial. The terms “we”, “us” and “our” refer to Blooming Artificial Ltd. We operate this website and online store (the “Services”) to provide information about and sell our products. These Terms of Service (“Terms”) set out your and our rights and responsibilities when you use the Services.

Please read these Terms carefully; they include important information about your legal rights, warranties and limitations of liability. By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, you should not use or access the Services.

Section 1 - Access & account

You may browse and purchase without creating an account. If you create an account, you’re responsible for keeping your credentials secure and for all activity on your account. Do not sell, transfer or share your account. You confirm any information you provide (e.g., contact, delivery and payment details) is accurate and up to date.

By using the Services, you represent that you are over 16 years old, and that you consent to any permitted use by your minor dependants on devices you own or control.

Section 2 - Our products

We aim to describe and present our products accurately. However, images and colours can vary by device and settings. Descriptions, specifications and prices may be corrected or updated at any time if errors occur. We may discontinue products or limit quantities at our discretion.

Section 3 - Orders

When you place an order, we email an acknowledgement confirming receipt. This is not acceptance. We may reject orders (e.g., out of stock, pricing/description error, payment not authorised). A contract forms when your payment is approved, pricing verified, and the order is processed and dispatched; we will send a dispatch confirmation email.
Title to goods may pass on dispatch; this does not affect the risk position in Section 5. Please review your order carefully before submitting.

Your purchases are returnable in line with our Returns. Promotions may affect refunds—see our Offers FAQ and Returns.

Section 4 - Prices & billing

Prices are shown in GBP and include VAT where applicable. Delivery charges (if any) are shown at checkout. We may correct errors or inaccuracies and update information at any time. You agree to provide current and accurate purchase and payment details and authorise us to take payment when you place an order.

Section 5 - Shipping & delivery

We use trusted delivery partners. Delivery times are estimates and may vary due to factors outside our control. If there is a significant delay before dispatch, you may cancel for a refund.

When risk passes: For consumer orders, risk passes to you on delivery into your physical possession (or that of a person you nominate). If you arrange your own carrier (not offered by us), risk passes when we deliver the goods to that carrier.

Loss or damage in transit: Please notify us of any damage within 30 days of delivery so we can arrange an exchange or refund; non-delivery should be reported within 10 days of dispatch (or sooner if tracking indicates an issue). Nothing in this section affects your statutory rights.

Section 6 - Intellectual property

All content on the Services (including text, images, graphics, videos, logos and layout) is owned by or licensed to Blooming Artificial Ltd and is protected by applicable laws. You may use the Services for personal, non-commercial purposes only. You must not copy, modify, distribute or create derivative works from our materials without permission.

Section 7 - Optional tools

We may provide access to tools or features provided by third parties. We supply these “as is” and “as available” without warranty and without liability arising from your use of them. Use is at your discretion and subject to the relevant third party’s terms.

Section 8 - Third-party links

The Services may include links to third-party websites or services. We are not responsible for and do not endorse third-party content or practices. Review their terms and privacy policies before engaging in any transaction.

Section 9 - Platform providers

Our ecommerce and website technology may be provided by third-party service providers. However, all sales are made by Blooming Artificial Ltd, and your contract of sale is with us. Those providers are not responsible for, and have no liability for, your purchases from us.

Section 10 - Privacy policy

Your personal information is handled in accordance with our Privacy Notice, which explains what we collect, why, the lawful bases we rely on, who we share it with (such as delivery and payment providers), and your rights.

Section 11 - Feedback

If you submit reviews, questions or other content (“Feedback”), you grant us a non-exclusive, transferable, royalty-free licence to use and display that Feedback in connection with our products and Services (for example, on product pages and marketing), provided we do not misrepresent you or your views. You confirm you own or control the rights in your Feedback and that it is lawful, accurate and not misleading. We may moderate Feedback where necessary (e.g., for unlawful, abusive or infringing content).

Section 12 - Errors, inaccuracies & omissions

From time to time there may be errors or omissions on the Services (e.g., descriptions, pricing, availability, shipping charges, transit times). We reserve the right to correct or update information and to decline orders based on such errors.

Section 13 - Prohibited uses

You must not use the Services: (a) for unlawful purposes; (b) to infringe intellectual property or privacy rights; (c) to transmit harmful or malicious code; (d) to send unauthorised advertising or spam; (e) to collect personal data unlawfully; (f) to interfere with or circumvent security features; or (g) in a way that harms or disrupts the Services. We may suspend or terminate access where misuse is suspected.

Section 14 - Termination

We may suspend or terminate access to the Services (or any part) at any time where reasonably necessary (e.g., for security, misuse, non-payment or legal compliance). You remain responsible for amounts due up to the date of termination. Provisions that by their nature should survive termination will continue to apply.

Section 15 - Disclaimer of warranties

The Services are provided for general information and shopping purposes only. Except as expressly stated in these Terms (including the warranty below) and your statutory rights, the Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, timely, secure or error-free operation. Nothing in this section limits or excludes rights that cannot be limited or excluded by law (including your rights under the Consumer Rights Act 2015).

Section 16 - Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.


Subject to the above, we will not be liable for: (a) losses that were not caused by our breach; (b) business losses (including loss of profits, revenue, contracts, data, goodwill or anticipated savings); or (c) losses that were not foreseeable to you and us when the contract was made. Your statutory rights remain unaffected.

Section 17 - Indemnification

Where permitted by law, you agree to indemnify us against third-party claims and reasonable costs arising from your breach of these Terms or misuse of the Services. This does not require you to indemnify us for our own negligence or for matters we are legally responsible for.

Section 18 - Severability

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

SECTION 19 – WAIVER; ENTIRE AGREEMENT
A failure to enforce a right is not a waiver. These Terms and any policies referenced (including the Privacy Notice, Delivery and Returns information, and Offers FAQ) constitute the entire agreement between you and us concerning the Services and supersede prior statements about the Services.

Section 20 - Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

Section 21 - Governing law

These Terms and our dealings with you are governed by English law and the courts of England have exclusive jurisdiction. Nothing limits any mandatory protections available to you under the law of your residence.

Section 22 - Headings

Headings are for convenience only and do not affect interpretation.

Section 23 - Changes to terms of service

We may update these Terms from time to time (for example, to reflect changes in law or our operations). We’ll post the updated Terms on this page and, where required by law, notify you of material changes. Your continued use of the Services after changes take effect constitutes acceptance.

Returns - Summary

• Returns window: as stated on our returns page (currently 30 days).
• Return costs: you’re responsible for return postage and ensuring items arrive in saleable condition unless you opted into Checkout+ at the point of order.
• Made-to-order items: not returnable unless faulty.
• Refunds: processed within 7 days of receipt. If you return the entire order, we also refund the basic outbound carriage (not any upgraded service). Your statutory rights remain unaffected.

Warranty - Summary

Unless a different period is stated on a product page, products are warranted to be free from defects in materials and workmanship for 12 months from purchase. We will replace or refund at our discretion where the warranty applies. Misuse (e.g., using indoor-only items outdoors) is excluded. This warranty is in addition to your statutory rights.
